Passenger Damages Always Compensated

Personal injury to a passenger in an accident in the Netherlands is ALWAYS compensated. There is no exception to this rule under Dutch law. The damage a passenger sustains as a result of an accident is always fully reimbursed. This is because the passenger is an innocent third party and can claim compensation. Many people mistakenly believe that passenger insurance is required for this. That is a major misunderstanding. Even if the driver of the vehicle in which the passenger is travelling is liable for the collision, the passenger is entitled to full compensation for damages.

The only exception is the driver themselves. If the driver is liable, they cannot claim compensation for their damages, unless they have passenger insurance. Passenger insurance is therefore intended for the driver in case they are at fault for an accident. Even if the driver is partially liable for the accident, they can claim compensation. In that case, a percentage of their own fault will be deducted from the final amount of damages.

Damage to a co-driver, occupant, or passenger is therefore always compensated.

Common types of damages include household help, self-sufficiency, pain and suffering, and loss of earning capacity.
