Which travel expenses are reimbursed in a personal injury case?
Travel expenses related to personal injury in the Netherlands are reimbursed under Dutch law. This reimbursement is paid by the liable party. The Personal Injury Council advises a standard amount per kilometer. This kilometer allowance is followed by judges in many cases.
The amount is €0.33 per kilometer (Kilometre Allowance Guideline, De Letselschade Raad).
Which trips are reimbursed?
Not all trips are reimbursed. The trips must be related to the accident. These include trips for the handling of the damage claim. In addition, trips to medical practitioners are reimbursed. This concerns:
- Travel expenses for family members. If these are for visiting the victim in the hospital or rehabilitation center.
- Travel expenses for the victim. If these are for visits to medical practitioners and representatives.
Travel expenses are part of the damage. Your lawyer can map out these costs. This is done free of charge for you. In addition, other damage items will be estimated and calculated. These include:
- loss of earning capacity
- pain and suffering compensation (smartengeld)
- direct costs (material damage, medical costs)
- household help
- self-activity (major chores in and around the house)
Your lawyer will also engage a medical advisor. This advisor can request the necessary information from your practitioners to substantiate and assess your damage. This is very important.
